21_21 DESIGN SIGHT Personal Partner Program Regulations

21_21 DESIGN SIGHT Co., Ltd. (hereinafter referred to as "the Operator") has stipulated the following regulations regarding the "21_21 Personal Partner Program" of 21_21 DESIGN SIGHT (hereinafter referred to as "the Facilities") operated by the Operator.

Article 1. Name

The official name of this program is the "21_21 DESIGN SIGHT Personal Partner Program." A member of this program is a "21_21 DESIGN SIGHT Personal Partner" (hereinafter referred to as "Personal Partner.")

Article 2. 21_21 Personal Partner

A Personal Partner is a person who applied to become a member of Personal Partner Program in accordance with and upon consent to these regulations and paid the fees to the Operator as prescribed in Article 5 of these regulations.

Article 3. Admission Procedures

  1. Those wishing to be admitted to the 21_21 Personal Partner Program (hereinafter referred to as "Prospective Personal Partner") shall first agree with these regulations by means of the mobile application services and the web services ArtSticker (hereinafter referred to as "ArtSticker") as provided by The Chain Museum Co., Ltd. (hereinafter referred to as "The Chain Museum") and then carry out application procedures. The Prospective Personal Partners shall observe the terms of use and these regulations.
  2. The Operator shall determine whether to grant admission based on the application for admission submitted by the Prospective Personal Partner. The admission procedure is completed when the Operator grants admission, the Operator notifies this to the Prospective Personal Partner, and the said Prospective Personal Partner pays the Personal Partner fee prescribed in Article 5.

Article 4.Period of Validity

The period of validity for Personal Partner status begins on the date on which the fees prescribed in the following article are paid and registration has been carried out, and continues for a period of 365 days.

Article 5. Personal Partner Fee

Prospective Personal Partners shall make payment of the following membership fees via ArtSticker according to the method determined by The Chain Museum.

¥10,000 per share (tax included)

Article 6. Withdrawal

  1. When ending the 21_21 Personal Partner Program, the Personal Partner is required to notify the Operator. In such a case, the Operator shall observe the obligation to return funds in response to the demand from the Personal Partner, said funds being limited to the amount from the fee resulting from a proportional monthly division for the number of months up to the month of membership withdrawal as well as the amount after deduction of the required fees for these Personal Partner membership procedures and usage.
  2. If the Operator notifies a Personal Partner the loss of Personal Partner qualification in the cases specified in the following items (provided, however, Personal Partner qualification shall be lost automatically without requiring notification in the case of item 7,) the Personal Partner shall lose Personal Partner qualification and be removed from 21_21 Personal Partner Program.
    1. If the Personal Partner obstructs the Operator in appropriately managing the Facility, such as conducting acts that become a nuisance to other users or acts in violation of rules concerning use of the Facility;
    2. If the Personal Partner conducts acts contrary to public order and morality;
    3. If the Personal Partner fails to pay the Personal Partner Fee stipulated in Article 5.
    4. If the Personal Partner is an anti-social force, etc. (gang, gang member, right-wing group, antisocial forces, or others equivalent thereto), or if the Operator discovers that the Personal
    5. Partner has interaction with or involvement in antisocial forces, etc.;
    6. If the Personal Partner violates any other provisions of these Regulations; or
    7. In the event of the Personal Partner's death.

Article 7. Services

  1. Personal Partner may receive the following services according to the method specified by the Operator.
    1. Free entry to 21_21 DESIGN SIGHT exhibitions hosted by the Facilities for Personal Partner and accompanying persons equal to number of shares.
    2. Priority entry at times of restricted entry due to crowds
    3. 10% discount off the purchase of original catalogues and goods (excluding some products).
    4. 100 yen discount off the admission price of the Suntory Museum of Art.
    5. Present of 21_21 notebook for the persons equal to number of shares.
    6. Name listed on the 21_21 DESIGN SIGHT website (upon request)
  2. The Operator may change the content of the services without prior notice to the Personal Partners. In this case, the Operator shall promptly notify Personal Partners of the modified content pursuant to the provisions in Article 10.
  3. The Operator may suspend its services without prior notice to the Personal Partners in the following specified situations.
    1. If urgent work needs to be carried out to maintain the operations of the Facilities or the 21_21 Personal Partner Program.
    2. If the Facilities have suffered damage from natural disaster or other catastrophe.
    3. Other similar emergency situations.
  4. The Operator may discontinue the 21_21 Personal Partner Program on one month's notice.
  5. If a Personal Partner incurs damages due to the discontinuation of the operation of 21_21 Personal Partner Program or due to the suspension, discontinuation, etc. of other services caused by reasons attributable to the Operator (except for the conscious intention or gross negligence of the Operator), the upper limit of the amount of damages that the Operator shall compensate shall be the amount of Personal Partner Fee paid by the said Personal Partner to the Operator.

Article 8. Prohibition of Transfer of Personal Partner Qualification

Personal Partners may not transfer, lend, or provide as collateral to a third party all or any part of the Personal Partner qualification or any other rights and/or obligations under these Regulations.

Article 9. Personal Information

  1. The Operator holds personal information received from the Personal Partner via The Chain Museum and shall protect personal information by the appropriate methods while observing the Act on the Protection of Personal Information and any other related laws and regulations concerning the protection and use of personal information.
  2. The Personal Partner's personal information can be used for the purpose of registration to the 21_21 Personal Partner Program, confirmation of identity, sending emails to notify exhibitions at Facilities and management as well as necessary items required for management of the Facilities, and shall not be used for other purposes.
  3. The Operator shall not disclose personal information to any third party, with the exception of the following cases.
    1. If the Operator entrusts the duty of communication with the Personal Partner to a third party under the condition of a non-disclosure agreement.
    2. If the Personal Partner gives his or her consent.
    3. By court order or any other court decision that requires disclosure.
    4. In case of a request from the police for cooperation in an investigation.
  4. In addition to what is provided for in the preceding paragraphs, the Operator shall be subject to the provisions stipulated in the separately prescribed privacy policy.

Article 10. Modification of Regulations

  1. The Operator may modify these regulations as needed. In this case, the Operator shall promptly notify the Personal Partner of the matters modified by the appropriate method selected by the Operator.
  2. The Operator shall not be held liable in any case whatsoever, including liability for damages, even in the case of damages incurred by the Personal Partners due to modification of these regulations and/or modified content of services pursuant to these regulations, except for cases where this was due to the conscious intention or gross negligence of the Operator.

Article 11. Governing Law and Court with Jurisdiction

These Regulations shall be governed by and be interpreted according to the Laws of Japan. The Operator and Personal Partners agree that all disputes between the Operator and Personal Partners arising with regard to these Regulations shall be subject to the exclusive jurisdiction of the first instance of the Tokyo District Court.

Supplementary ProvisionsThese
regulations shall come into force on January 18, 2023.
